Terms & Conditions

1          DEFINITIONS

The following definitions apply unless the context requires otherwise:

1.1               Cash Back means the amount specified on the Hitachi Cash Back Website against each particular Qualifying Hitachi Projector or Interactive Flat Panel Display;

1.2               Commencement Date means the commencement date for Registrations and for return of Goods to the Recycler, being  [15/04/2013];

1.3               Customer means the owner of the Goods;

1.4               Customer Representative means a person authorised by the Customer to Register the Customer on the Hitachi Cash Back Website;

1.5               Customer Transaction ID means the unique reference number and bar code issued to Customer upon successful Registration & submission of product to be Recycled;

1.6               Expiry Date means the expiry date for Registrations and return of Goods to the Recycler, prior notice of which will be given by Hitachi on the Hitachi Cash Back Website;

1.7               Goods means any data projector;

1.8               Hitachi means Hitachi Australia Pty Ltd ACN 075 381 332 of Avaya House, Suite 801, Level 8, 123 Epping Road, North Ryde NSW 2113;

1.9               Hitachi Cash Back Program means the program operated by Hitachi under which Hitachi agrees to make a Cash Back payment to participating Customers who return Goods to the Recycler and, within the Term, purchase one or more Qualifying Hitachi Projectors or Interactive Flat Panel Displays and upload details of such purchases to the Hitachi Cash Back Website against their Customer Reference;

1.10            Hitachi Cash Back Website means the internet website provided by Hitachi through which all participating Customers must register, located at www.hitachi.com.au/projectgreen;

1.11             Qualifying Hitachi Projector or Interactive Flat Panel Display means any of the Hitachi branded models specified as participating projectors or interactive flat panel displays on the Hitachi Cash Back Website and that are purchased in Australia from an authorised Hitachi dealer during the Term;

1.12            Recycler means Hitachi’s nominated recycler, being [Reverse E-Waste];

1.13            Registration means the submission by Customer Representative of information requested on the Hitachi Cash Back Website in relation to the Customer for the purpose of enabling the Customer to participate in the Hitachi Cash Back Program; and

1.14            Term for the purchase of Qualifying Hitachi Projectors or Interactive Flat Panel Displays means the term of the Hitachi Cash Back Program, commencing 30 days prior to the Commencement Date and expiring 90 days after the Expiry Date.


2                    TERMS AND CONDITIONS

2.1               These Terms and Conditions govern the operation of the Hitachi Cash Back Program and must be read in conjunction with the various other information set out on the Hitachi Cash Back Website, all of which information forms part of these Terms and Conditions.

2.2               By registering a Customer on the Hitachi Cash Back Website, Customer Representative acknowledges that he/she is authorised to bind the Customer to these Terms and Conditions and agrees on behalf of Customer to be bound by these Terms and Conditions.


3                    REGISTRATION

3.1               To be eligible to participate in the Hitachi Cash Back Program, Customer Representative must make a valid Registration of the Customer on the Hitachi Cash Back Website between the Commencement Date and the Expiry Date.

3.2               A Registration will be a valid Registration where all fields in the on-line registration form are accurately completed.  Hitachi reserves the right to invalidate incomplete or inaccurate Registrations or Registrations made after outside the Commencement or Expiry Dates and to withdraw Registrations where the information provided is found to be materially incorrect or the Customer Representative is found not to be authorised to make such Registration.

3.3               Upon completion of Registration, Customer will be issued with a Customer Reference to facilitate return of Goods to Hitachi’s nominated Waste Recycler and upload of details of purchase of any Qualifying Hitachi Projector or Interactive Flat Panel Display.  The Customer Reference should be printed and stored securely by Customer.


4                    RETURN OF GOODS

4.1               At any time between the Commencement Date and the Expiry Date, Customer must procure the return of the Goods to the Recycler using the reply paid label accompanying the Customer Reference. 

4.2               Details of how to arrange for return of Goods to the Recycler will be provided at the time of provision of the Customer Reference. Maximum package sizes apply for the collection of Reply Paid Goods.

4.3               Nothing in these Terms and Conditions is intended to imply that either Hitachi or Recycler is purchasing the Goods from Customer. Return of the Goods to Recycler is a precondition of Customer’s participation in the Hitachi Cash Back Program.


5                    CLAIMING CASH BACK

5.1          To be eligible for a Cash Back, Customer must, during the Term:

(a)          Return for recycling one or more Goods;

(b)          Purchase one or more Qualifying Hitachi Projectors or Interactive Flat Panel Displays;

(c)           Upload to the Hitachi Cash Back Website genuine and authentic proof of purchase, model and serial numbers of the Qualifying Hitachi Projector(s) or Interactive Flat Panel Display(s) against Customer’s Reference; and

(d)          Comply with these Terms and Conditions.

5.2          The Customer must retain the proof of purchase for the Qualifying Hitachi Projector(s) or Interactive Flat Panel Display(s) for a period of 6 months after the date of purchase of the goods.

5.3          The proof of purchase supplied as part of the purchase verification process, to Hitachi, must display the name of the organisation matching the name of the organisation that has completed the Registration

5.4          This cash-back amount will be provided to you by bank transfer. The nominated bank account must display the name of the organisation, matching the name of the organisation that has completed the Registration. Please allow 30 days for this process.

5.5          The maximum number of Cash Back claims that can be made by a Customer is the lesser of:

(a)          The number of Goods returned for recycling; and

(b)          The number of Qualifying Hitachi Projectors or Interactive Flat Panel Displays purchased and notified to Hitachi pursuant to clause 5.1(c) of these Terms and Conditions.


6             CUSTOMER WARRANTIES

6.1          Customer warrants that:

(a)          It owns or otherwise has the right to dispose of the Goods; and

(b)          Return of the Goods to the Recycler will not infringe on the rights of any third party.


7              SECURITY RISK

7.1          Third parties may intercept or modify transmissions to and from the Hitachi Cash Back Website and it is possible that computer viruses or other defects may be contained in files obtained from or through the Hitachi Cash Back Website.  Hitachi is not liable for any damage that may be a result of the Customer’s use of the Hitachi Cash Back Website or of any linked website.


8             CONFIDENTIALITY

8.1          Any information collected under the Hitachi Cash Back Program will be used for the sole purpose of administering the Hitachi Cash Back Program and will be subject to Hitachi’s Privacy Policy, a copy of which is available at [www.hitachi.com.au/privacy]


9             GENERAL

9.1          These Terms and Conditions are governed by the laws of New South Wales, Australia. If any part of these Terms and Conditions is found to be invalid or unenforceable, it shall be removed without affecting the remainder.

9.2          These Terms and Conditions contain all of the terms and conditions of the contract between the parties and may only be varied by agreement in writing between the parties.

9.3          Any conditions found to be void, unenforceable or illegal may, to that extent be severed from these Terms and Conditions.

9.4          No waiver of any of these Terms and Conditions or failure to exercise a right or remedy by Hitachi will be considered to imply or constitute a further waiver by Hitachi of the same or any other term, condition, right or remedy.
